By downloading or using the Sleep Early iOS application (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
The App is licensed, not sold, to you. The developer grants you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions.
The App is provided to you “as is” and “as available” without warranties of any kind, express or implied. The developer does not guarantee that:
The App is intended for general lifestyle and habit-tracking purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. If you have concerns about your sleep or health, please consult a qualified healthcare professional.
The App offers optional in-app purchases (currently a one-time “Premium” upgrade). All purchases are:
The developer cannot directly issue refunds. Refund requests must be submitted to Apple.
You retain full ownership of any data you create or input in the App (such as your check-in records). The developer has no access to this data and makes no claim of ownership.
The App does not allow you to share data with other users or post any user-generated content publicly.
The App, including all source code, designs, graphics, text, and trademarks, is the property of the developer (or its licensors) and is protected by copyright and other intellectual property laws.
You may not:
To the fullest extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:
Your sole remedy for any dissatisfaction with the App is to discontinue use of the App.
These Terms remain in effect until terminated by you or the developer.
You may terminate these Terms at any time by uninstalling the App from your device.
The developer may terminate these Terms or your access to the App if you violate these Terms or for any other reason, with or without notice.
Upon termination, the license granted to you ends, but you may continue to use any data you have stored locally on your device or in your iCloud.
The developer may modify these Terms at any time. Material changes will be reflected in the “Last Updated” date at the top of this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions. For disputes that cannot be resolved informally, the parties agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction.
You acknowledge that these Terms are between you and the developer, not between you and Apple Inc. Apple is not responsible for the App or its content. However, Apple is a third-party beneficiary of these Terms and may enforce them against you.
In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple terms shall control with respect to the relationship between you and Apple.
